Personally Identifiable Information

ESA does not share, disclose or sell any personally identifiable information (such as your name, address, telephone number or email address) collected online on ESA sites with third parties for non-ESA marketing purposes.

In the unlikely event that ESA should decide to share such data with third parties for marketing in future, it will provide notification and the opportunity for its users to indicate whether they would prefer that the Company not provide such information about them to third parties.

Because this information is a critical part of our business, it would be treated like our other assets in the context of a merger, sale or other corporate reorganization or legal proceeding.

ESA also does not market to, or knowingly collect personal information from children under the age of 16 on Company sites.

How We Use Information
ESA uses the personally-identifiable information we collect online principally to provide you with the service(s) you have ordered and to make service announcements from time to time.

Postal and e-mail address information, for example, enables communication about services offered and ordered, as well as the proper provisioning and billing of those services.

Like most businesses, ESA uses professional and reputable vendors to carry out certain functions (such as processing recurring debit order collections) and so shares online data to the extent necessary for them to perform their work. Of course, such vendors must use that personally-identifiable information only for the purpose(s) for which it was shared and protect it from any further use. ESA may also share such information with other industry and credit-related organizations to improve operations and to protect against fraud, security and credit risks.

We also provide personally-identifiable online information in response to subpoenas and other legal demands, and where we believe that disclosing this information is necessary to identify, contact or bring legal action against individuals who may be endangering public safety or interfering with ESA property or services, or with our customers' or others' use of them.

How We Collect Information

ESA collects information online by asking you for it, for example, when you order a service or respond to a survey. A customer's name, address (postal and e-mail) and telephone number are the most important pieces of information, but we might request other information, based on, for example, the service(s) being ordered or promoted.

If you choose to pay for your service(s) by debit order, we will request you’re banking details to include in periodic debit order transactions.

ESA may also use "cookies" and similar technology to obtain information about your visits to our sites or your responses to e-mail from us - both individually and in aggregated data that does not identify you. These reporting tools tell us the parts of our web sites or e-mails in which you showed an interest or took some action, and help us improve the quality and usefulness of our sites. At ESA, we primarily use cookies to determine what services or promotions you are interested in. While cookies help us improve your experience while visiting our sites and customize our communications to the services you may desire, you have the option to block them through your Internet browser or other commercially available software. However, doing so may make some of our sites' features unavailable to you.

Security
We use encryption, firewalls and other technology and security procedures to help protect the accuracy and security of your personal information and prevent unauthorized access or improper use. For example, you will note that while using some features of the ESA web sites and online services, you will need to submit a password or some other type of authenticating information.

Your Access To Information

You may review or update the available personally identifiable information that we received from you online by accessing your profile online, by contacting our Help Desk or e-mail address, or through the Company contact information below. Please note that in order to better protect you and safeguard your information, we take steps to verify your identity before granting access or making corrections to your information.

ESA may use e-mail addresses you provide us online on ESA sites to send you e-mails related to ESA products and services.

Fishing Regulations

All ESA members will apply to the South African fishing regulations as per MCM (Marine and Costal Management).  If and when not adhering to these regulations stipulated on your fishing license you will forfeit your ESA membership and necessary actions will be taken against your misconduct by MCM.  ESA will not be held responsible for any actions taken by MCM against an ESA member.

Payment

ESA Membership debit orders will take place on the 30th of each month or the closest week day in the occasion that the 30th falls on a weekend;  where the particular month does not consist of 30 days it will take place on the last week day of such month.
If for any reason what so ever your debit order is returned as unpaid you will be charged with a administration fee of        R 100.00 for the first unsuccessful debit order return.  Please note that your membership benefits will be forfeited the following month until your account is rectified. A double debit will be processed against your account in an attempt to rectify your account.
If for any reason ESA can not debit your account with the monthly amount for 2 (TWO) consecutive months your membership benefits will be blocked up to or until your account has been rectified and your membership reinstated.  After confirmation of payment regarding all your outstanding ESA membership fees your benefits will continue as per agreement in and between you, the ESA member, and ESA.

Competition
In any form of competitions or lucky draw promoted or managed by ESA the judges’ decision will be final.

ESA Membership Card
As an ESA member you should at any given time be able to furnish your ESA Membership Card on request with a valid personal identification.  If your ESA Membership Card gets lost or stolen it will be the cardholder’s responsibility to notify ESA of the incident within 48 hours via e-mail ( This e-mail address is being protected from spambots. You need JavaScript enabled to view it ).  ESA will furnish the member with a new card at an additional administration fee.

Benefits
ESA holds the full right to change, ad and subtract any ESA Membership benefit without any written notice.  In such case notice of change in benefits will be listed on the ESA website (www.ESAworld.co.za)

Allowed Use & Licence
ESA licenses the User to view, download and print the content of the ESA web site, provided that such content is used for personal, educational and/or non-commercial purposes only.

Content from the ESA web site shall not be used or exploited by Users for any commercial and non-private purposes without the prior written consent of ESA.

If any User uses content from the ESA web site in breach of the provisions detailed herein:
•    ESA reserves the right to claim damages from the User;
•    ESA reserves the right to institute criminal proceedings against the User; and
•    ESA shall not be liable, in any manner whatsoever, for any damage, loss or liability that resulted from the use of such content by the User or any third party who obtained any content from the User.
No person may frame the ESA web site, in any manner whatsoever, without the prior written consent of Virgin Active.

Intellectual Property Rights & Domain Name Use
All intellectual property on the ESA web site, including but not limited to content, trademarks, domain names, patents, design elements, software, databases, text, graphics, icons and hyperlinks are the property of or licensed to Charadon Production Studios and as such, are protected from infringement by domestic and international legislation and treaties.

ESA is a trademark and Users agree not to use the trademark as an element of a domain name or sub domain name, notwithstanding the fact that such domain name use or registration may be allowed in terms of trademark and/or constitutional law. Upon request to do so a User shall immediately cease to use such domain name and transfer it to Charadon Production Studios at the cost of the User.

 

Your membership will be automatically renewed every year without notice unless
otherwise notified 30 days prior to renewal.
